Protecting Your Rights After an Injury

What Evidence Should You Gather to Help Fight Your Car Accident Case?

Whenever you are involved in an auto accident, you need to protect your rights and ability to pursue compensation from available insurance. A car crash can quickly impact your entire life, but making a mistake in the aftermath can prove to be costly. One mistake can permanently reduce your ability to file a claim with the other person’s insurance company, your own insurance company or to file a lawsuit for money damages. These steps can help you.

Gather Information

Getting as much information can be very helpful, including from the other driver involved in the accident and any witnesses to the crash. Depending on the insurance coverages available, you may be going through your own insurance company, but the more information you can provide the insurance company, the less ability they have to fight your claim.

Take Photos

Make sure you’re taking photos. If you’ve got a smartphone, now is the time to use it. You want to take a picture of the scene where the accident occurred (from as many angles as possible), the damage to all vehicles involved, and the physical injuries you sustain. As they say, pictures are worth a thousand words. Make sure you get as many pictures as possible.

Get Medical Help

Your health needs to be a top priority. If you suffer injuries in a car accident, you want to be sure that you’re getting checked out by a doctor to determine what kind of injury you have, how severe it is, and what treatment options you need to recover.

Unfortunately, this isn’t the time to be tough. The insurance companies take the position that if you don’t go to the doctor, you aren’t hurt. If there is a gap in treatment (a totally normal thing in most cases) they will use that to argue that you weren’t hurt in the wreck, no matter how ridiculous that seems.

Treat early, treat often. If the doctor recommends you do something, do it.

Hire Legal Representation

Whenever you need to go through the complex process of filing a claim, either against your own insurance or in a third-party lawsuit, having legal counsel to protect your rights is usually a good decision. Even if you don’t hire a lawyer, a lawyer can help you make the best decision in your case.

A lawyer can help you fully understand your rights and options, so you know what to expect every step of the way.
